Terms and Conditions of the Labuna Online Store
defining, among others, the rules for concluding contracts via the Store, and containing key information about the Seller, the Store, and Consumer rights.

§ 1 DEFINITIONS

Business Days – Monday through Friday, excluding public holidays in Poland.
Civil Code – the Act of April 23, 1964, Civil Code.
Consumer – a consumer within the meaning of the Civil Code.
Account – a free feature of the Store (a service provided electronically) regulated by a separate set of terms, allowing any Store user to create an individual account.
Buyer – any entity purchasing from the Store.
Privileged Buyer – a Buyer who is a Consumer or a Privileged Entrepreneur.
Privileged Entrepreneur – a natural person concluding a contract with the Seller directly related to their business activity, but not having a professional character for them.
Terms and Conditions – these terms and conditions.
Store – the Labuna online store operated by the Seller at www.labuna.pl.
Seller – DAWID KRAKOWIAK, conducting business under the name LABUNA DAWID KRAKOWIAK, registered in the Central Registration and Information on Economic Activity in Poland, NIP: 8121875919, REGON: 384156345, ul. Odkryta 56B/19, 03-140 Warsaw.
Consumer Rights Act – the Act of May 30, 2014, on Consumer Rights.

§ 3 TECHNICAL REQUIREMENTS

To use the Store properly, the following are required:

  • An internet-connected device

  • A web browser that supports JavaScript and cookies

To place an order, in addition to the above, an active email account is required.


§ 4 SHOPPING IN THE STORE

  • Product prices displayed in the Store are total prices.

  • The total order price includes the product price and, if applicable, shipping costs.

  • Products should be added to the cart to purchase them.

  • The Buyer selects delivery and payment methods and provides necessary data.

  • The order is placed upon confirmation and acceptance of the Terms and Conditions.

  • Placing an order constitutes a sales contract.

  • The Buyer may create an Account or shop as a guest.

  • During promotions, the lowest price in the last 30 days and the basis for the discount (e.g., "seasonal sale") are shown.

  • For new products (<30 days), the lowest available price since launch is shown.


§ 5 PAYMENTS

Available payment methods:

  • Bank transfer

  • Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro

  • Payment platforms: Paynow, Autopay S.A

  • Cash on delivery (card/cash upon delivery)

  • Card or cash upon personal pickup

Prepaid orders must be paid within 7 business days.
Some payment methods require payment immediately after ordering.
By purchasing, the Buyer consents to receive electronic invoices. Consent may be withdrawn.


§ 6 ORDER FULFILLMENT

  • Fulfillment time is indicated in the Store.

  • Orders paid in advance are processed after payment.

  • If products with different fulfillment times are ordered, the order is processed within the longest time.

  • Delivery is limited to Poland.

  • Delivery options: courier, InPost parcel lockers, or personal pickup.

  • For personal pickup, products are ready on the specified date.


§ 7 REVIEWS AND PERSONALIZATION

  • Reviews come only from actual Buyers (verified by order number).

  • The Store may use profiling (e.g., “Customers who bought X also buy Y”) but does not make automated decisions that have legal effects (e.g., denial of sale or higher pricing).


§ 8 RIGHT OF WITHDRAWAL

A Privileged Buyer has the right to withdraw from the contract within 14 days without giving any reason.

The 14-day period begins:

  • Upon receiving the product (or the last item in a multi-part order)

  • Or when a third party designated by the Buyer receives the product

To exercise this right, the Buyer must inform the Seller (using contact info from §2) via a clear statement (e.g., letter or email).
Using the template withdrawal form (Annex 1) is optional.
To meet the deadline, it's enough to send the notice before it expires.


EFFECTS OF WITHDRAWAL

  • The Seller refunds all payments, including shipping (except extra costs for non-standard delivery methods), within 14 days of notification.

  • Refunds are made using the same payment method unless otherwise agreed—at no cost to the Buyer.

  • The Seller may withhold the refund until receiving the goods or proof of return.

  • Goods should be returned to: Showroom Labuna, ul. Płocka 22A, 01-138 Warsaw within 14 days.

  • The Buyer bears direct return shipping costs.

  • The Buyer is liable for any diminished value resulting from improper use.

  • If the product cannot be returned by regular post due to its nature, the Seller will inform the Buyer about estimated return costs.

  • Card payment refunds are returned to the card’s bank account.


§ 9 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right does not apply to contracts for:

  • Non-prefabricated goods made to the Buyer's specifications

  • Perishable goods or those with short shelf life

  • Sealed goods that cannot be returned after opening for health/hygiene reasons

  • Goods inseparably mixed with others after delivery

  • Audio/video recordings or software in sealed packaging once opened

  • Newspapers or magazines (except subscription contracts)

  • Price-based contracts subject to market fluctuations beyond the Seller’s control


§ 10 COMPLAINTS

I GENERAL

  • The Seller is liable to Privileged Buyers for conformity with the contract under applicable law, especially the Consumer Rights Act.

  • Complaints should be submitted via postal or email addresses in §2.

  • If the product is under warranty, its terms are available in the Store.

  • Website operation complaints should be emailed to the address in §2.

  • The Seller will respond to complaints within 14 days.

II PRIVILEGED BUYERS – GOODS

  • In case of non-conformity, Buyers can demand a repair or replacement (per Chapter 5a of the Consumer Rights Act).

  • Liability lasts 2 years from delivery (unless a longer shelf life is stated).

  • Buyers may also demand a price reduction or withdrawal from the contract if:

    • The Seller refuses or fails to restore conformity;

    • The defect remains despite attempts to fix it;

    • The issue is serious enough to justify immediate withdrawal;

    • It's evident that timely or non-burdensome conformity will not be achieved.

  • The Buyer must provide the product for repair/replacement. The Seller covers the shipping cost.

  • The right to withdraw does not apply to minor non-conformities.

  • If withdrawing, the Buyer must return the product promptly to Showroom Labuna at the Seller’s cost.

  • The Seller refunds the price immediately after receiving the return.


    §11 PERSONAL DATA

    The administrator of the personal data provided by the Buyer in connection with purchases in the Store is the Seller.
    Detailed information regarding the processing of data by the Seller, including other purposes and legal bases for processing, as well as the recipients of the data, is included in the Privacy Policy available in the Store — in accordance with the transparency principle under the General Data Protection Regulation (GDPR).
    The processing of the Buyer's personal data is based on the contract and for its execution, in accordance with the rules specified in the GDPR.
    Providing personal data by the Buyer is voluntary but necessary for concluding the contract.
    The Buyer has the right to request:

    • access to their data,

    • correction,

    • deletion,

    • restriction of processing,

    • data portability to another controller,

    • to object to data processing,
      as well as the right to lodge a complaint with the President of the Personal Data Protection Office.
      Detailed principles for exercising these rights are described in the Privacy Policy.


    §12 RESERVATIONS

    It is prohibited for the Buyer to provide content of an unlawful nature.
    Each order placed in the Store requires acceptance of the Terms and Conditions (in its current version).
    Contracts are concluded in accordance with Polish law.
    In the event of any dispute with the Seller, the matter may be resolved by the court competent under generally applicable provisions.
    The Seller reserves the right to amend the Terms and Conditions for important reasons, such as changes in the law or changes in payment and delivery methods — to the extent that these changes affect the implementation of the provisions of the Terms and Conditions.
    For contracts concluded before the amendment of the Terms and Conditions, the version of the Terms and Conditions in force at the time of placing the order shall apply.
    For privileged Buyers (e.g., consumers), the amended Terms and Conditions are binding if they have been properly informed of the changes and have not terminated the continuous contract within 14 days from the date of notification.
    In the case of a dispute with a non-privileged Buyer (e.g., a business), the court competent for the Seller’s registered office shall have jurisdiction.
