ACCOUNT TERMS AND CONDITIONS
at the Labuna Store

§ 1 DEFINITIONS
Consumer – a consumer as defined by the provisions of the Civil Code.
Account – a free function of the Store (service), regulated by these Terms, allowing the User to set up an individual account in the Store.
User – any entity creating or interested in creating an Account.
Privileged User – a User who is a Consumer or a natural person entering into an agreement with the Service Provider directly related to their business activity, but not of a professional nature for them.
Terms – these Account Terms and Conditions.
Store – the Labuna online store operated by the Service Provider at www.labuna.pl.
Service Provider – DAWID KRAKOWIAK, an entrepreneur operating under the business name LABUNA DAWID KRAKOWIAK, entered in the Central Registration and Information on Business (CEIDG) maintained by the minister competent for economy, NIP 8121875919, REGON 384156345, ul. Odkryta 56B/19, 03-140 Warsaw.

§ 3 TECHNICAL REQUIREMENTS
To properly function and set up an Account, the following are required:

an active e-mail account
-
a device with Internet access
-
a web browser supporting JavaScript and cookies
§ 4 ACCOUNT
-
Creating an Account is entirely voluntary and depends on the User's will.
-
An Account provides the User with additional features such as viewing order history, checking order status, or editing User data independently.

To create an Account, the relevant form in the Store must be filled out.
-
Upon account creation, a contract for an indefinite period is concluded between the User and the Service Provider for Account management, in accordance with these Terms.

The User may resign from the Account at any time, free of charge.
-
To resign, the User must send a resignation notice to the Service Provider via e-mail to sklep@labuna.pl, resulting in immediate deletion of the Account and termination of the Account management contract.
§ 5 COMPLAINTS

Complaints regarding the functioning of the Account should be sent to sklep@labuna.pl.

The Service Provider will consider the complaint within 14 days.
OUT-OF-COURT DISPUTE RESOLUTION AND CLAIMS
If the complaint procedure does not bring the desired result, the Consumer may use, among others:
-
mediation conducted by the territorially competent Provincial Inspectorate of Trade Inspection (WIIH), where an application for mediation must be submitted (usually free of charge). A list is available at: https://uokik.gov.pl/wojewodzkie_inspektoraty_inspekcji_handlowej.php;
-
assistance from a permanent consumer arbitration court at the WIIH, by filing an application to hear the case (generally free). A list of courts is available at: https://uokik.gov.pl/stale_sady_polubowne.php;

free assistance of a municipal or district Consumer Ombudsman;
-
the online ODR platform available at: https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.
§ 6 PERSONAL DATA

The Service Provider is the controller of the personal data provided by the User while using the Account.
-
Detailed information on the processing of personal data (purposes, legal basis, data recipients) is available in the Store's Privacy Policy, in accordance with the transparency principle of the GDPR.

The purpose of processing the User’s data is to manage the Account. The legal basis includes:
-
contract performance or pre-contractual steps (Article 6(1)(b) GDPR),
-
legitimate interests of the Service Provider, such as the establishment, exercise, or defense of legal claims (Article 6(1)(f) GDPR).

Providing data is voluntary but necessary to manage the Account. Failure to provide data will prevent Account setup.
-
Data will be processed until:
-
the Account is deleted by the User or Service Provider at the User’s request,
-
the period for claims related to the Account expires,
-
the User objects to processing based on legitimate interests – whichever comes later.

The User has the right to:
-
access their personal data,
-
rectify their data,
-
delete their data,
-
restrict processing,
-
transfer their data to another controller,
-
object, at any time and for reasons related to their particular situation, to processing based on Article 6(1)(f) GDPR.
To exercise these rights, the User should contact the Service Provider.
If the User believes their data is being processed unlawfully, they may file a complaint with the President of the Personal Data Protection Office.
§ 7 RESERVATIONS

It is forbidden for the User to provide unlawful content.

The Account management agreement is concluded in Polish.
-
The Service Provider may amend the Terms for valid reasons, as described in section 4.
Valid reasons include:
-
the need to comply with applicable laws,
-
improving service security,
-
changing Account functionality requiring modifications to the Terms.

The User will be notified at least 7 days before the planned change takes effect via e-mail.
-
If the User does not accept the planned change, they must notify the Service Provider via e-mail at sklep@labuna.pl, resulting in termination of the Account agreement upon the effective date of the change or earlier if requested.

If the User does not object before the change takes effect, they are deemed to have accepted it. This does not prevent termination of the agreement at a later date.

In the event of a dispute with a User who is not a Privileged User, the competent court shall be the one with jurisdiction over the Service Provider's registered office.
